Process for Student, Staff, and Faculty Complaints Related to Sexual Misconduct, Discrimination, and Harassment
- When an individual expresses a concern that relates or potentially relates to sexual misconduct (including sexual assault, exploitation and harassment, intimate partner abuse, and stalking), protected-class discrimination and harassment, and any retaliation at CU Boulder, any “responsible employee”[1] at the Law School who learns of the complaint has an obligation to report it to the Office of Institutional Equity and Compliance (the OIEC). This document outlines the steps that should be taken when such a concern is expressed to a responsible employee at the Law School.
- If the concern (whether expressed by a student, staff, or faculty member) triggers a mandatory report to OIEC,[2] the responsible employee records the complaint on a Complaint Report Form, along with the date of the complaint and the date it was reported to OIEC. If the concern has not yet been reported to the OIEC, the responsible employee reports the concern to OIEC. Complaint Report Forms are saved in the xxxx.
- Concerns expressed by students should be reported to the Sr. Asst. Dean of Students, regardless of who originally received the complaint, and regardless of whether the responsible employee has also reported the concern to the OIEC. Likewise, concerns expressed by staff or faculty members should be reported to the Senior Human Resources Director, regardless of who originally received the complaint, and regardless of whether the responsible employee has also reported the concern to the OIEC. The Sr. Asst. Dean of Students or the Senior Human Resources Director should report the concern to the OIEC if it has not already been reported.
- The Sr. Asst. Dean of Students, in the case of a concern expressed by a student, or the Senior Human Resources Director, in the case of a concern expressed by a staff or faculty member, tracks and records OIEC’s response to the complaint on the Complaint Report Form.
- The Dean of Students or the Senior Human Resources Director tracks and records any additional actions taken by the law school in response to the complaint using the Complaint Report Form.
[1] A “responsible employee” is any employee with the authority to hire, promote, discipline, evaluate, grade, formally advise, or direct faculty, staff, or students
[2] A concern triggers the requirement to report to the OIEC if it potentially relates to the following subject matter: sexual misconduct (including sexual assault, exploitation and harassment, intimate partner abuse, and stalking), protected-class discrimination and harassment, and any retaliation at CU Boulder. A responsible employee must report any conduct potentially related to such subject matter, regardless of whether it is the accuser or the victim who is a member of the CU community, and regardless of where the incident occurred or how information about it was conveyed. When in doubt, consult with OIEC and allow them to make the determination regarding whether a concern falls within their jurisdiction.
