OCG and Venture Partners have been working together to solidify the process between our two units for Allocation of Rights agreements. Signature authority for these types of agreements resides with Venture Partners, and as such effective January 13, 2022, Venture Partners has responsibility for drafting, negotiating and signing Allocation of Rights agreements.

OCG will facilitate requests for an Allocation of Rights agreement with Venture Partners, and Venture Partners will provide the fully executed and signed agreement to OCG to be entered into infoEd.

What is an Allocation of Rights agreement?

  • Allocation of Rights agreements facilitate the use and ownership of any intellectual property (IP) developed under a Research & Development Small Business Innovation Research (SBIR) or Small Business Technology Transfer (STTR) award.
  • Allocation of Rights agreements may required at time of proposal by the Federal Sponsor. If required, the small business submitting a proposal for an SBIR or STTR award may reach out to CU with a request for an Allocation of Rights agreement. When required at Proposal, the Federal government is requesting a pre-award demonstrated IP commitment by the small business and the university, should the Federal government move forward with issuing an SBIR or STTR award.
  • The purpose is for small business and research institution to agree on how to allocate intellectual property rights for follow-on research, development or commercialization
